Thank you for visiting primeandme.com (“Platform”, “We”, “Us”, or “Our”). These Terms of Service (“Terms”) govern your access to and use of the Platform, including all services, features, and content provided therein. By accessing or using the Platform, you agree to be bound by these Terms, which form a legally binding agreement between you and Primeandme. If you do not agree with these Terms, please do not access or use the Platform or any of its services or content.

1. Overview of the Platform

Primeandme is an online marketplace that allows users (“Users”, “You”) to deposit their Twitch Prime subscription benefits (or equivalent, referred to as “Deposited Benefits”) through one of our designated affiliates. Users may then select digital products or services (“Products”) offered on the Platform. Primeandme is responsible for buying and supplying the Products available on the Platform. Primeandme facilitates the deposit of Twitch Prime benefits through affiliates but does not own or directly provide the Twitch Prime benefits. Primeandme is not affiliated with Twitch Interactive, Inc. (“Twitch”), Amazon.com, Inc., or their affiliates, unless otherwise stated.

2. Eligibility

To use the Platform, you must:

• Be a natural person at least 13 years of age. Users under 18 must have parental or legal guardian consent to use the Platform.
• Be a legal resident of a country where access to and use of the Platform’s services are permitted under applicable law.
• Have a valid Twitch account linked to an active Twitch Prime or Amazon Prime subscription (where applicable).
• Provide complete and accurate information when setting up your user account.

Primeandme reserves the right to request proof of identity or age to verify compliance with these Terms and to prevent fraud. Failure to provide accurate information may result in suspension or termination of your account.

3. License to Use the Platform

Subject to your compliance with these Terms, Primeandme grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable, limited-scope license to access and use the Platform and its services. This license is for personal use only and does not permit you to:

• Modify, reverse-engineer, or decompile any part of the Platform.
• Use the Platform for any unauthorized or illegal purpose.
• Transfer or assign your account to another person without prior written consent from Primeandme.

4. User Accounts and Responsibilities

To access the Platform’s services, you must create an account and provide accurate information, including but not limited to your Twitch account details and contact information. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Promptly notifying Primeandme at primeandme@gmail.com if you suspect unauthorized access to your account.

Primeandme reserves the right to suspend or terminate your account if we suspect fraudulent activity, inaccurate information, or violation of these Terms.

5. Depositing Twitch Prime Benefits

• Process: Users may deposit their Twitch Prime subscription benefits (e.g., channel subscriptions, in-game loot, or other digital benefits) by directing them to an affiliate designated by Primeandme. The affiliate will verify the deposit, and upon confirmation, Users will receive one Prime in their account on the Platform.
• Prime Currency: Each Twitch Prime subscription benefit deposited is credited as exactly one Prime. The Prime does not have a specific monetary value; its value depends on the Product selected by the User from those offered on the Platform. Primeandme reserves the right to adjust the terms of Prime allocation at its discretion.
• Non-Transferable: Primes are non-transferable and may only be used to select Products on the Platform.
• No Refunds: Deposited Benefits are non-refundable once processed, except as required by applicable law (e.g., consumer withdrawal rights in the EU/EEA/UK, as outlined in Section 11).

6. Selecting Products

• Product Selection: Users may use their Primes to select digital Products offered on the Platform. All Products are digital and will be delivered digitally (e.g., via email, account access, or digital codes).
• Primeandme Responsibilities: Primeandme is responsible for buying and supplying the digital Products available on the Platform. Primeandme will make reasonable efforts to ensure the quality, availability, and digital delivery of Products but does not guarantee their condition, legality, or suitability beyond what is required by applicable law.

7. Third-Party Services

• Twitch and Amazon: The Platform integrates with Twitch and may require linking your Twitch or Amazon account. Your use of Twitch Prime benefits is subject to Twitch’s Terms of Service and Terms of Sale. Primeandme is not responsible for changes to Twitch’s services or policies.
• Affiliates: Affiliates are entities designated by Primeandme to process Twitch Prime benefit deposits. Affiliates do not have separate terms applicable to Users, and Primeandme is responsible for overseeing their role in the deposit process. Primeandme does not assume liability for affiliate actions beyond its control.

8. Prohibited Conduct

You agree not to:

• Use the Platform to engage in fraudulent activities, such as depositing invalid or unauthorized Twitch Prime benefits.
• Attempt to bypass, manipulate, or exploit the Platform’s systems or processes.
• Use the Platform to distribute unlawful, infringing, or harmful content.
• Impersonate any person or entity, including Primeandme staff or affiliates.
• Violate any applicable laws, regulations, or third-party rights, including Twitch’s Community Guidelines.

9. Fraud Prevention

Primeandme staff will never request your Twitch Prime benefits or account credentials outside the Platform’s official processes. If you receive suspicious communications claiming to be from Primeandme, do not respond and immediately report them to primeandme@gmail.com. We are not liable for losses resulting from third-party fraud or unauthorized actions.

10. Privacy

We collect and process your personal information in accordance with our Privacy Policy at https://primeandme.com/privacy. By using the Platform, you consent to such processing and agree to provide accurate information.

11. Consumer Rights (EU/EEA/UK)

If you are a consumer residing in the European Union, European Economic Area, or the United Kingdom, you may have a right to withdraw from or cancel certain transactions (e.g., Product purchases) within a 14-day cooling-off period, as outlined in Twitch’s Terms of Sale or applicable law. This right does not apply to digital content (e.g., in-game items) once accessed or used, or to Deposited Benefits once processed.

12. Disclaimer of Warranties

The Platform and all services, content, and Products are provided “AS IS” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement, except as required by applicable law. Primeandme does not guarantee the availability, accuracy, or results of using the Platform or its Products.

13. Limitation of Liability

To the fullest extent permitted by law, Primeandme shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to losses from:

• Errors or delays in processing Deposited Benefits or Product transactions.
• Affiliate actions beyond Primeandme’s control.
• Unauthorized access to your account due to your failure to secure it.
• Changes to Twitch Prime benefits or policies.

Our total liability for any claim shall not exceed the value of the Primes or Products involved in the transaction.

14. Termination

Primeandme reserves the right to suspend or terminate your access to the Platform, without notice, for any reason, including but not limited to:

• Violation of these Terms.
• Suspected fraudulent or unauthorized activity.
• Technical or business reasons preventing us from providing services.

Upon termination, any unused Primes may be forfeited, and you will lose access to the Platform’s services.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall be governed by the laws of Sweden. You agree to attempt informal resolution by contacting primeandme@gmail.com before pursuing legal action. If unresolved, disputes shall be settled through the courts of Sweden.

16. Modifications to Terms

Primeandme may update these Terms at any time by posting the revised version on the Platform with an updated “Last Updated” date. Continued use of the Platform after such changes constitutes your acceptance of the updated Terms.
