Welcome to primeandme.com ("Primeandme", "Platform", "We", "Us", or "Our"). These Terms of Service ("Terms") govern your access to and use of the primeandme.com website, services, and related applications (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms, which constitute a legally binding agreement between you and Primeandme. If you do not agree with these Terms, you must not access or use the Platform.

Primeandme is a charity-driven platform that allows users to log in with their Twitch account, select a registered charity ("Affiliate") to donate their Twitch Prime subscription to, and earn a platform-specific currency ("Primes") that can be used to claim game keys provided by game developers and publishers. Affiliates must also log in with their Twitch account to participate.

Please read these Terms carefully, as they include important information about your rights, obligations, and the limitations of our liability.

1. Eligibility and Account Registration

1.1 User Eligibility

To use the Platform, you must:

  • Be at least 13 years old. If you are under 18, you must have the consent of a parent or legal guardian.
  • Be a legal resident of a country where access to and use of the Platform and Twitch services is permitted.
  • Have a valid Twitch account linked to an active Amazon Prime or Prime Video membership to donate a Twitch Prime subscription.
  • Provide accurate and complete information when registering or linking your Twitch account.

1.2 Affiliate Eligibility

To participate as an Affiliate (charity), you must:

  • Be a registered charitable organization in good standing under the laws of your jurisdiction.
  • Have a valid Twitch account and comply with Twitch's Terms of Service.
  • Provide accurate and verifiable information about your charitable status and Twitch account during registration.
  • Agree to receive Twitch Prime subscriptions from users and comply with Primeandme's policies for Affiliates.

1.3 Account Security

When you sign in to the Platform through Twitch, Primeandme will receive your Twitch user ID and related information (e.g., username, avatar) via the Twitch API. You are solely responsible for:

  • Maintaining the confidentiality of your Twitch account credentials and any Primeandme-specific login information.
  • All activities conducted under your account, whether authorized or unauthorized.
  • Notifying Primeandme immediately atsupport@primeandme.comif you suspect unauthorized access to your account.

Primeandme reserves the right to suspend or terminate your account if we suspect fraudulent activity, inaccurate information, or violation of these Terms.

2. Platform Use and Services

2.1 User Services

Primeandme allows users to:

  • Log in using their Twitch account.
  • Select a registered Affiliate (charity) to donate their Twitch Prime subscription to.
  • Earn one (1) Prime, a platform-specific currency, for each valid Twitch Prime subscription donated to an Affiliate's channel.
  • Redeem Primes to claim game keys provided by game developers and publishers, subject to availability. The specific platform for each game key (e.g., Steam, Epic Games Store) will be clearly indicated before claiming.

2.2 Affiliate Services

Primeandme allows Affiliates to:

  • Register as a charity by linking their Twitch account and providing verifiable proof of charitable status.
  • Receive Twitch Prime subscriptions donated by users through the Platform.
  • Benefit from the financial proceeds of Twitch Prime subscriptions as paid by Amazon, in accordance with Twitch's policies.

2.3 Game Keys

  • Game keys are provided by third-party game developers and publishers and are subject to their terms and conditions.
  • The specific platform for each game key (e.g., Steam, Epic Games Store) will be clearly indicated before a user claims the key.
  • Primeandme does not guarantee the availability, functionality, or compatibility of game keys.
  • Game keys are non-transferable, non-refundable, and may only be redeemed using Primes earned through the Platform.
  • Primeandme reserves the right to modify the availability of game keys or the number of Primes required to claim them at any time.

2.4 License to Use the Platform

Subject to your compliance with these Terms, Primeandme grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable, limited license to access and use the Platform for its intended purpose. This license does not permit:

  • Unauthorized access to or modification of the Platform's systems or content.
  • Use of the Platform for commercial purposes without prior written consent from Primeandme.
  • Any activity that violates these Terms, Twitch's Terms of Service, or applicable law.

3. User and Affiliate Conduct

You agree not to:

  • Use the Platform to engage in fraudulent, deceptive, or illegal activities, including misrepresenting your identity or charitable status.
  • Attempt to manipulate the Platform's currency system (Primes) or game key redemption process.
  • Send unsolicited messages, spam, or promotional materials to other users or Affiliates.
  • Harvest or collect personal information from other users or Affiliates without their consent.
  • Use the Platform in a way that violates Twitch's Terms of Service, Amazon's Prime policies, or any third-party terms applicable to game keys.

Primeandme reserves the right to investigate and take action, including account suspension or termination, against any user or Affiliate who violates these Terms.

4. Twitch Integration and Prime Donations

4.1 Twitch Prime Donations

  • Users may donate their Twitch Prime subscription to an Affiliate's Twitch channel through the Platform.
  • Donations are subject to Twitch's Terms of Service and Amazon's Prime membership terms.
  • Primeandme facilitates the connection between users and Affiliates but is not responsible for the processing or payment of Twitch Prime subscriptions, which are handled by Twitch and Amazon.
  • Primeandme does not charge any fees or take a commission from Twitch Prime donations.
  • Upon a successful donation, the user's account will be credited with one (1) Prime, which can be used to claim game keys.

4.2 Affiliate Responsibilities

  • Affiliates must maintain an active Twitch account and comply with Twitch's policies to receive Prime subscriptions.
  • Affiliates are responsible for reporting and managing any financial proceeds from Twitch Prime subscriptions in accordance with applicable tax and charity laws.
  • Primeandme is not responsible for any disputes between Affiliates and Twitch or Amazon regarding subscription payments.

5. Primes Currency

  • Earning Primes: Users earn one (1) Prime for each valid Twitch Prime subscription donated to an Affiliate's channel, as verified by Primeandme.
  • Non-Transferable: Primes are non-transferable, non-exchangeable, and have no cash value.
  • Expiration: Primes may expire if not redeemed within a specified period, as determined by Primeandme and communicated to users.
  • Fraud Prevention: Primeandme reserves the right to withhold, cancel, or reverse Primes if we suspect fraudulent activity, including multiple account creation or misuse of Twitch Prime subscriptions.

6. Game Keys and Third-Party Content

  • Third-Party Providers: Game keys are provided by third-party game developers and publishers. Primeandme is not responsible for the quality, availability, or functionality of game keys.
  • Platform Specification: The specific platform for each game key (e.g., Steam, Epic Games Store) will be clearly indicated before a user claims the key.
  • Redemption: Game keys are redeemed through third-party platforms and are subject to their terms and conditions.
  • No Refunds: Game keys are non-refundable and cannot be exchanged for cash or other items.
  • Availability: Primeandme does not guarantee the continuous availability of specific game keys or the ability to redeem Primes for desired keys.

7. Fraud and Security

  • No Impersonation: Primeandme staff will never request your Twitch credentials or send unsolicited requests for account verification. If you receive such a request, report it immediately to support@primeandme.com.
  • Fraud Reporting: You must report any suspected fraudulent activity or unauthorized access to your account promptly.
  • No Liability for Fraud: Primeandme is not liable for any damages or losses resulting from fraudulent actions by third parties, including those impersonating Primeandme staff or Affiliates.

8. Privacy and Data Protection

Your use of the Platform is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy. Information shared with Twitch or third-party platforms (e.g., for game key redemption) is subject to their respective privacy policies.

9. Intellectual Property

  • Platform Content: All content on the Platform, including text, graphics, logos, and software, is the property of Primeandme or its licensors and is protected by copyright and other intellectual property laws.
  • User Content: You grant Primeandme a non-exclusive, worldwide, royalty-free license to use, display, and store any content you submit to the Platform (e.g., profile information) for the purpose of operating and promoting the Platform.
  • Third-Party Content: Game keys and related content are provided by third parties and are subject to their intellectual property rights.

10. Limitation of Liability

To the fullest extent permitted by Swedish law, Primeandme and its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform, including but not limited to:

  • Loss of data, profits, or opportunities.
  • Errors or interruptions in the Platform's services.
  • Issues with Twitch Prime subscriptions, game keys, or third-party platforms.
  • Fraudulent actions by third parties.

Primeandme's total liability for any claim arising from these Terms will not exceed SEK 1,000.

11. Termination

Primeandme reserves the right to suspend or terminate your access to the Platform, your account, or any services at our sole discretion, without notice, for reasons including but not limited to:

  • Violation of these Terms.
  • Fraudulent or unauthorized use of the Platform.
  • Technical or business reasons that prevent us from continuing to provide services.

Upon termination, your license to use the Platform will cease, and any unused Primes may be forfeited.

12. Modifications to the Terms

Primeandme may update these Terms at any time by posting the revised version on the Platform. The updated Terms will take effect immediately upon posting. Your continued use of the Platform after such changes constitutes your acceptance of the revised Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of Sweden, without regard to its conflict of law principles. Any disputes arising from these Terms will be resolved through binding arbitration in Stockholm, Sweden, in accordance with the rules of the Arbitration Institute of the Stockholm Chamber of Commerce. You waive your right to participate in class action lawsuits or class-wide arbitration.

15. Miscellaneous

  • Entire Agreement: These Terms, along with the Privacy Policy, constitute the entire agreement between you and Primeandme regarding the use of the Platform.
  • Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
  • No Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.
  • Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. Primeandme may assign these Terms at our discretion.
